Most common types of court proceedings:
- Removal Proceedings (INA § 240): The primary and most frequent proceeding used to determine if a noncitizen is removable and whether they qualify for relief or protection (such as asylum, cancellation of removal, or adjustment of status).
- Bond Proceedings: Separate custody redetermination hearings where a detained individual asks an immigration judge to set or lower a cash bond so they can be released while their case is pending.
- Asylum-Only Proceedings: Limited proceedings restricted strictly to evaluating asylum, withholding of removal, or Convention Against Torture (CAT) claims for individuals who are not eligible for standard removal proceedings (such as crewmembers, stowaways, or Visa Waiver Program entrants).
- Withholding-Only Proceedings: Specialized hearings for individuals who already have a final order of removal or reinstatement, limited solely to whether they qualify for withholding of removal or CAT protection because of a fear of persecution or torture.
- Rescission Proceedings: Rare proceedings used to determine if a person’s previously granted lawful permanent resident (green card) status should be rescinded because they were not actually eligible for it at the time.
- Deportation and Exclusion Proceedings: Older types of proceedings initiated before April 1, 1997, which have largely been replaced by removal proceedings but may still rarely appear in legacy or reopened pending cases.
Applicants can also file to suspend, stay or dismiss their proceedings.
